Police To Quiz Ogun Magistrate President Mulero, Other Judicial Officials For Alleged Over Judgment
A civil Rights Organization, Centre for Human Rights and Social Justice (CHRSJ) accused and dragged some judicial officials and their cohorts in Ogun State before the Nigeria Police Force (NPF).
In a Statement issued and Signed by its Executive Chairman, Comrade Adeniyi, Alimi Sulaiman on Thursday, which made available to the Journalist say’s it is based on the CHRSJ Petition letter to the Inspector General of Police and Assistant Inspector General (AIG) in-charge of Zone (2) Police Command, Onikan Lagos, who monitoring Lagos and Ogun state security affairs, dated on Wednesday 2nd of May, 2018, Prompt the Police into this action of public interest to beginning their investigation on those Officials and their cohorts.
According to the Group, who named those judicial officials as Alhaji Chief R. Bidemi Mulero of the Grade 1 Customary Court, Imasayi, under Iju Local Council Development Area (LCDA), Iboro who is also the President of Ogun State Customary Court and one Honourable Yaya A. Ogundare (a member of the same Court) alongside their senior clerical officer, Miss. Bello F. A. of gross misconduct.
That on July 27th, 2017, these judicial officers issued a forged judgment in favour of one Fatai Mulero who is a younger brother to the so called the president of the court, Chief Mulero. The judgement also favoured one Jamiu Babalola and Mr. Rasaki Akindele against Mr. Yekinni Mustapha who is now a Late, due to the fusillade of threats alleged to have been fired on him (Late Pa. Yekinni Mustapha) over a land dispute by the so called purported fake judgement Plaintiffs/Claimants.
Meanwhile, the so-called president, Chief Mulero lack qualification to head the court by the virtue of Section (8), Sub-section (1C) of the Customary Courts (Amendment) Law of 2018 which was accented to by Ogun State Governor on 13th Day of March, 2017 the Group stated.
In that Law, which stipulated that the President of the Grade 1 Customary Court shall be a person, who is qualified to practice as a Barrister and solicitor in Nigeria and shall have so qualified for a period not less than five Years of post-call experience, “which so called Alhaji Chief R. Bidemi Mulero, the President of Imasayi Grade 1 Customary Court does not possess, the Law section Stated.
According to the CHRSJ Petition letter, which read in Parth that it is in pursuance of this aims and objectives make us file this petition to your good offices to request for immediate arrest and interrogation /Trial of this aforementioned suspected people. Which the matter had in the past been investigated by the Criminal Investigation and Intelligence Department of the State Police Command, Abeokuta and now at the Legal Department of the Zone (2) Police Command, Onikan Lagos.
The Group also mentioned the Name of other suspects as Fatai Mulero, Jamiu Babalola, Abel Bamgbose and suspected fake military general called Rasaki Akindele for conspiracy, Stealing and threat to life.
More so, in response to the matter by the Barrister at Law, a person of Chief Wakeel Olawale Liady, Barrister Oluseyi Raheem, Barrister Hamudalat Azees-Adediran(Mrs.), Barrister Remi Akintunde, Rotimi Komolafe Esq and Barrister Taiwo A. Alli says, “each Court has inherent power to set aside any judgement which she delivers without jurisdiction, if any court discovers that she lacks jurisdiction or that a judgement was obtained by fraud, same court can on her on motion or on the application of anybody affected by the judgement set aside the judgement, Suit No. IMS/1/2017 between Mr. Fatai Mulero & Anor and Mr. Abel Bamgbose & Anor, which was delivered on Thursday the 27th day of July 2017 was obtained by Fraud and without jurisdiction.
The Group of Lawyer said it in another litigation of Suit No./ESGI/3cl/2018 in another Customary Court Grade (1) holden at Ilaro judicial Division under thesame Ogun state, onbehalf of Mr. Saubana Opaleye, Mrs. Oluwatoyin Kudoro, Bosede Towobola and Mrs. Rosanna Ayoka Kuye as the Plaintiffs against the same allegedly Suspected people in the Zone (2) Police Command.”The Statement Concluded.
