NATIONAL ASSEMBLY PASSES PERSONS WITH DISABILITIES BILL IN KENYA

The National Assembly of Kenya has passed the Persons with Disabilities Bill, marking a significant milestone in the country’s journey towards inclusivity and equality.

In press statement dated 16th January 2025, the bill, sponsored by Senator Crystal Asige and cosponsored by Hon. Kimani Ichung’wah, aims to give effect to Article 54 of the Constitution, which guarantees the rights of persons with disabilities.

“The new legislation seeks to restructure the National Council for Persons with Disabilities, providing a robust framework for protecting, promoting, and monitoring the rights of individuals with disabilities.

“The bill introduces tax relief measures for employees with disabilities, tax exemptions for imported materials and equipment, and incentives for donations and subsidies benefiting persons with disabilities,” reads part of the statement.

It said that employers who make reasonable accommodations for employees with disabilities will also benefit from tax exemptions, promoting a more inclusive work environment.

Reads the statement in part: “The bill repeals the outdated Persons with Disabilities Act, No. 14 of 2003, replacing it with a law that aligns with the Constitution and emphasizes a human rights approach.”
